- Primero. DEJAR SIN EFECTOS el auto proferido por la Corte Suprema de Justicia, Sala de Casación Civil, de fecha 5 de febrero de 2009, en el que decretó la nulidad de lo actuado en primera instancia por el Tribunal Superior de Bucaramanga.
- Segundo. REMITIR el expediente a la Corte Suprema de Justicia, Sala de Casación Civil, para que sin más demoras, resuelva la impugnación presentada dentro del proceso de tutela iniciado por Wilinton Rincón Peñaranda contra el Ministerio del Medio Ambiente, Vivienda y Desarrollo y la oficina del Fondo Nacional de Vivienda - Fonvivienda.
- Tercero. Por Secretaría General, COMUNICAR al Juzgado
